LAST WILL AND TESTAMENT

  • A Will is extremely important to have. Especially if both parents pass away. If you do not have a Will, the government will decide who takes care of your minor children.
  • It is not necessary to have a Will if you are survived by a spouse. However, the Prophet Salla Allahu Alaihi Wa Sallam urged us to have a one.
  • It is not necessary to the have the Will done by a Lawyer like many people think.
  • You may or may not want to notarize your Will. It is sufficient that 2 or 3 witnesses who are not family members sign it. You just need to let people know where your Will is safeguarded (safety box, etc), so that they know that you have a Will and where to find it. You can, if you wish, get the signature notarized so that nobody disputes its authenticity.
  • Both you and your spouse should have a Will.
  • Article II-d is specially written for people who do not have family members, other than spouses and children, in Canada.
  • The Will does mention ISNA numerous times. This is because it was written by ISNA, Jazahum Allah Khairan. However, the testator can change the Will to use the organization(s) of their choice i.e. ICNA, WIA,... etc.
